Fort Lox

Storage Service Agreement

Box Rental and Storage

Revision September 28, 2026

This Storage Service Agreement (the "Agreement") is between FortLox LLC, a Florida limited liability company doing business as Fort Lox Storage ("Fort Lox"), and the customer identified in the Fort Lox account through which this Agreement is accepted ("Customer" or "you"). It takes effect on the date you accept it electronically. Schedule A (Storefront, Retrieval and Courier Policy), Schedule B (Subscription Packages, Weight Limits, Prohibited Items and Fees) and, where you are enrolled in the pilot program, Schedule C (Pilot Program Acknowledgment) are part of this Agreement, together with the Fort Lox Terms of Service and Privacy Policy.

PLEASE READ THIS AGREEMENT CAREFULLY. IT PROVIDES FOR AUTOMATIC MONTHLY BILLING UNTIL YOUR BOXES ARE RETURNED (SECTION 5), LIMITS FORT LOX'S LIABILITY FOR YOUR PROPERTY (SECTION 9), ALLOWS FORT LOX TO END YOUR STORAGE, RETURN YOUR BOXES AND KEEP YOUR DEPOSIT IF YOU DO NOT PAY (SECTION 11), GIVES FORT LOX A LIEN ON YOUR STORED PROPERTY (SECTION 12), AND REQUIRES ARBITRATION OF DISPUTES ON AN INDIVIDUAL BASIS (SECTION 19).

1. The Service

Fort Lox rents you one or more storage boxes (each a "Box") under the subscription package you select, and stores each Box for you at its facility. You pick up your empty Boxes at the Fort Lox storefront, or, where Fort Lox offers it, have them delivered by courier for the fee in Schedule B. You pack and lock each Box at your home and either bring it back to the storefront or, where offered, schedule a courier pickup. Fort Lox stores the Box on its shelving until you ask for it. When you want a Box, you request it in the Fort Lox app or website, Fort Lox pulls it to the storefront holding area during business hours, and you collect it by scanning its QR code. You may open the Box at the storefront or take it home for as long as you like. While you are paying the monthly fee, the Box is yours to use wherever it is (the "Service"). The property you place in a Box is your "Stored Property."

Fort Lox's storefront and facility are located at 1331 S. Dixie Highway, Unit 5-A, Pompano Beach, Florida, 33060 and the adjacent storage area (together, the "Facility"). Fort Lox may store your Boxes at the Facility or at any other Florida location it operates, subject to Section 13.

2. Nature of Our Relationship

While a Box is in Fort Lox's possession, Fort Lox holds it and your Stored Property as a warehouse and bailee for hire under Chapter 677, Florida Statutes. While a Box is in your possession, this Agreement is a rental of personal property and the Box and its contents are at your risk. This Agreement is not a lease of real property. It gives you no right to enter the storage area of the Facility or any space within it, and Fort Lox alone decides where and how Boxes are shelved. Fort Lox is not an insurer, is not a mover or carrier, and is not your agent.

3. Subscription Packages

Fort Lox offers subscription packages that differ by Box size, number of Boxes, term of commitment and price, as described in the app and in Schedule B. Your package is the one shown at checkout. Fort Lox may add, change or withdraw packages for new orders at any time, and may change the fees under an existing package on at least 30 days' written notice; if you do not accept the new fees you may terminate this Agreement before the new fees take effect by returning your Boxes under Section 14, in which case the prior fees apply through the date of return.

4. Boxes and Lock Kit

Boxes remain Fort Lox's property. You may use a Box only to store your own Stored Property under this Agreement, may not alter it, and may not let anyone else use it. You must purchase the Fort Lox lock kit (the "Lock Kit") with your first order and must secure each Box with a Fort Lox lock before returning it to Fort Lox. Fort Lox will not accept a Box that is not locked. You are responsible for your key or combination. Fort Lox does not keep a copy and will not open a Box except as Section 8 permits. You must return each Box empty, clean and in the condition in which you received it, ordinary wear excepted. If a Box is lost, stolen or damaged while in your possession or is returned damaged or not empty, you will pay the replacement, cleaning or repair charge in Schedule B.

5. Term, Fees, Deposit and Automatic Billing

Storage of each Box begins on the date you collect it at the storefront or it is delivered to you (the "Start Date"). This Agreement continues month to month and renews automatically each month until every Box has been received back by Fort Lox empty and in good condition. [Optional annual package: If you select an annual package, the initial term is twelve months from the first Start Date, prepaid at the annual rate, and the Agreement continues month to month after that.]

At checkout you pay the first month's fee for each Box, the deposit described below, the Lock Kit, and any delivery fee shown at checkout, less any promotional code. The fees are stated in Schedule B and at checkout.

AUTOMATIC MONTHLY BILLING. The monthly fee for each Box is a recurring charge. Fort Lox will charge the payment method on file on the Start Date of each Box and on the same day of every month after that (or the last day of a shorter month) until the Box is received back by Fort Lox empty and in good condition. Stopping use of the app, closing your account or removing your payment method does not stop the charge. To end the monthly fee for a Box you must return it as provided in Section 14. You may cancel at any time, effective at the end of the month you have already paid for, with no advance notice, through the app or website, or by email to fortloxstorage@gmail.com. Monthly fees are charged in advance, are not prorated, and are not refunded for any part of a month. Fort Lox will send a receipt for each charge to the email on your account.

You authorize Fort Lox and its payment processor to charge the payment method on file for every amount you owe under this Agreement, including delivery, pickup and handling fees, late fees, replacement, cleaning and repair charges, return costs and administrative fees under Section 11, lien enforcement costs, and applicable taxes. You must keep a valid payment method on file. A payment not received within five days after its due date is late, and Fort Lox may charge the late fee in Schedule B.

Deposit. You will pay a deposit for each Box (the "Deposit"), calculated automatically at checkout by the number and size of Boxes ordered, in the amount stated in Schedule B. The Deposit secures your obligations under this Agreement and is set at the replacement cost of the Box, the cost of returning the Box to you, and Fort Lox's administrative fee for processing a default. Fort Lox holds the Deposit without interest and may apply it to any amount you owe, including under Section 11. When you terminate and every Box has been returned empty, clean and undamaged, Fort Lox will refund the Deposit, less any amounts applied, to the payment method on file within [14] days after the last Box is received back, with an itemized statement of any deductions.

6. Access and Retrieval

You may request any Box as often as you like during Fort Lox's business hours, which are posted at the storefront and in the app. Requests are made in the app or website. Fort Lox will have the Box in the storefront holding area within [one business day] after your request, or sooner where the app so indicates. To collect a Box you or an adult you have authorized in the app must present government-issued identification and scan the Box's QR code, and Fort Lox will record the release. You may open the Box in the customer area of the storefront or take it home. Fort Lox may set reasonable limits on the number of Boxes staged in the holding area at one time, may charge the handling fee in Schedule B for more than [four] retrievals of the same Box in a calendar month, and may require that a Box left in the holding area more than [three] business days after it is ready be returned to storage.

Where Fort Lox offers courier delivery and pickup, it is an optional service within the delivery area shown in the app, for the flat fee in Schedule B, subject to courier availability, and governed by Schedule A.

7. Packing, Weight Limits and Prohibited Items

You are solely responsible for packing your Stored Property. You must pack each Box so that its contents are protected from ordinary handling, must not exceed the weight limit for that Box size in Schedule B, and must not place in any Box any item listed as prohibited in Schedule B or otherwise unlawful, hazardous, perishable or living, or that could damage other property or the Facility ("Prohibited Items"). Each time you return a Box to Fort Lox you will certify electronically that it contains no Prohibited Items, is within the weight limit and is securely locked. Fort Lox and its couriers may refuse to accept, and may return to you at your expense, any Box that is overweight, unlocked, leaking, damaged, emitting odors, or that Fort Lox reasonably believes contains Prohibited Items. You are liable for all loss, damage, cleanup costs, fines and claims caused by Prohibited Items or improper packing.

8. Inventory Records and Opening a Box

The app allows you to name each Box and to record and photograph its contents under its QR code ("Inventory Records"). Inventory Records are for your convenience only. Fort Lox does not verify them, and they are not a warehouse receipt for, or evidence of, the contents, condition or value of any Box. Only you can view your Inventory Records, except as the Terms of Service permit disclosure to Fort Lox staff for operations and support and to law enforcement and governmental authorities as described in Section 13.

Fort Lox will not open a Box except (a) with your consent, (b) when Fort Lox reasonably believes the Box contains Prohibited Items or presents a risk to people or property, (c) when required by law, a court order, a warrant or a governmental authority, (d) to enforce its lien under Section 12, or (e) to identify and return Stored Property under Section 13. If Fort Lox opens a Box, it will document the opening and contents by photograph and notify you promptly unless the law prohibits notice. Fort Lox may remove and dispose of Prohibited Items found in a Box, may report them to the appropriate authorities, and may charge you the disposal fee in Schedule B and any actual costs.

9. Care of Stored Property, Declared Value and Limitation of Liability

While a Box is in its possession, Fort Lox will exercise the care of a reasonably careful person in storing and handling it. Fort Lox stores Boxes in a climate-controlled area but does not guarantee any particular temperature or humidity. Fort Lox is not liable for loss or damage caused by fire, flood, storm, hurricane, water intrusion, mold, mildew, pests, power failure, theft by third parties, acts of God or any cause beyond its reasonable control, except to the extent caused by Fort Lox's failure to exercise reasonable care. Fort Lox has no responsibility for a Box or its contents while the Box is in your possession or in the possession of anyone you authorize, or after it has been left at a drop-off location you designated under Schedule A.

DECLARED VALUE AND LIABILITY CAP. Fort Lox's total liability for loss of or damage to the Stored Property in any Box, however caused, is limited to the value you declare for that Box in the app before returning it to Fort Lox (the "Declared Value"). If you declare no value, the Declared Value of each Box is [$500]. You may declare a higher value for a Box, up to the maximum Fort Lox offers, by written request in the app before returning the Box or within twenty-four hours after Fort Lox receives it, and Fort Lox may charge the increased-value surcharge in Schedule B. This limitation is agreed under Section 677.204, Florida Statutes, and does not apply to conversion of your Stored Property by Fort Lox to its own use.

NO CONSEQUENTIAL DAMAGES. IN NO EVENT WILL FORT LOX BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR SENTIMENTAL VALUE, LOSS OF USE, LOST PROFITS OR EMOTIONAL DISTRESS, ARISING FROM LOSS OF OR DAMAGE TO STORED PROPERTY OR FROM THE SERVICE. FORT LOX HAS NO LIABILITY FOR PROHIBITED ITEMS OR FOR ITEMS OF EXTRAORDINARY VALUE THAT YOU DID NOT DECLARE.

Claims. Inspect each Box when you collect it and report any loss or damage in the app or by email to fortloxstorage@gmail.com within [15] days after you collect it, with photographs and a description of the loss. A Box released with its Fort Lox lock intact is presumed released with its contents undisturbed. Any action against Fort Lox relating to the Stored Property or this Agreement must be commenced within one year after the date the claim arose.

10. Insurance

Fort Lox does not insure your Stored Property. You must keep your Stored Property insured for its full value while it is in Fort Lox's possession, whether under a homeowner's or renter's policy or a separate policy, and any insurance you carry is primary to Fort Lox's liability under Section 9. You will cause your insurer to waive any right of subrogation against Fort Lox, and any policy that does not contain such a waiver will not satisfy this requirement. [Option A: Fort Lox may make available a tenant storage insurance program through a licensed insurance agency. Enrollment is optional, the premium is billed with your monthly fee, and any claim is between you and the insurer.] [Option B: As a condition of the Service you must either enroll in the tenant storage insurance program offered in the app or provide proof of your own insurance covering the Stored Property before your first Box is returned to Fort Lox.]

11. Non-Payment: Notice, Default and Return of Your Boxes

If a monthly fee or other charge is not paid when due, Fort Lox will send you a payment reminder by email and text within five days after the due date. If the amount remains unpaid ten days after the due date you are in default, Fort Lox may charge the late fee, and Fort Lox may suspend retrievals, deliveries and pickups and decline to release any Box until your account is paid in full.

If the amount remains unpaid fifteen days after the due date, Fort Lox may terminate this Agreement by written notice and end the storage of your Boxes as follows. For each Box in Fort Lox's possession, Fort Lox may return the Box, locked and unopened, to the address on file in your account by courier or common carrier, and the Box is deemed returned to you when it is delivered to that address or left there in accordance with Schedule A. For each Box in your possession, Fort Lox may demand its return within ten days, and if it is not returned Fort Lox will treat the Box as lost. In either case Fort Lox will apply your Deposit to the cost of returning the Box, to the administrative fee in Schedule B, to the replacement cost of any Box not returned, and then to any unpaid fees. You remain liable for any balance, and Fort Lox will refund any unapplied portion of the Deposit. The parties agree that the administrative fee is a reasonable estimate of Fort Lox's cost of processing a default, which would be difficult to determine, and is not a penalty.

You may cure a default and reinstate the Service at any time before a Box has been shipped back to you, but in no event later than thirty days after the termination notice, by paying everything you owe, including late fees. Once Fort Lox has begun proceedings under Section 12, your right to cure is governed by that Section.

12. Warehouse Lien When a Box Cannot Be Returned

If Fort Lox is unable to return a Box to you under Section 11 because the address on file is invalid, the delivery is refused or undeliverable, or you cannot be reached at the contact information on your account, Fort Lox will hold the Box and its Stored Property subject to its lien for all storage, handling and other charges due under this Agreement and the expenses of preserving the Stored Property and enforcing the lien, as provided in Section 677.209, Florida Statutes.

Fort Lox may then enforce its lien by selling or disposing of the Stored Property in the manner provided in Section 677.210, Florida Statutes. Fort Lox will first send you, by certified mail or personal delivery to the address on your account and by email, a notice stating the itemized amount due, describing the Stored Property, demanding payment, and giving you a date not less than fourteen days after the notice is sent by which to pay. If you do not pay by that date, Fort Lox may sell the Stored Property at public sale at or near the Facility after advertising the sale once a week for two consecutive weeks in a newspaper of general circulation where the sale is to be held, with the sale held not less than fifteen days after the first publication. Fort Lox may dispose of Stored Property that has no apparent commercial value. Fort Lox will apply the proceeds to the amount you owe and the costs of the sale and will hold any surplus for you. You remain liable for any deficiency. You may redeem your Stored Property at any time before the sale by paying everything you owe, including the costs of preparing for the sale.

13. Special Situations

Hazardous, illegal or dangerous contents. If Fort Lox reasonably believes a Box contains Prohibited Items, it may act under Section 8, may immediately terminate this Agreement, may report the matter to law enforcement or environmental authorities, and may charge you all resulting costs.

Legal process.Fort Lox will comply with any subpoena, court order, search warrant or other lawful demand of a court, law enforcement agency or governmental authority concerning your account, your Inventory Records or your Stored Property, and may permit the authority to open or remove a Box. Fort Lox will notify you of the demand unless the law or the authority prohibits notice. Fort Lox is not liable to you for complying with lawful process, and your monthly fees continue while a Box remains in Fort Lox's possession.

Death or incapacity. You may designate in the app an authorized contact who may act for you under this Agreement if you die or become incapacitated (an "Authorized Contact"). If Fort Lox receives credible notice of your death or legal incapacity, it will continue to hold your Boxes for up to [90] days and will release them to (a) the personal representative of your estate upon presentation of letters of administration issued by a Florida court, (b) a court-appointed guardian or agent acting under a valid durable power of attorney, upon presentation of letters of guardianship or the power of attorney, (c) your Authorized Contact, or (d) where no personal representative or guardian has been appointed, a surviving spouse or adult child who presents a certified death certificate and signs an affidavit and indemnity in a form acceptable to Fort Lox, in each case after payment of all charges then due. Fort Lox may charge the estate the monthly fee during the holding period and, after the holding period, may proceed under Section 11 or 12.

Relocation of the Facility.Fort Lox may move your Boxes to another Florida facility it operates within [25] miles of the Facility on at least 30 days' written notice. If Fort Lox relocates farther than that, or closes the Facility without an alternative within that distance, you may terminate this Agreement without charge, Fort Lox will return your Boxes to you at no cost, and Fort Lox will refund your Deposit and any prepaid fees for the period after the return.

Casualty. If the Facility is damaged so that Fort Lox cannot safely store Boxes, Fort Lox may relocate the Boxes as provided above or return them to you at no charge, and will refund any prepaid fees for the period after the return.

Ending the Service.Fort Lox may terminate this Agreement for its convenience on at least 30 days' written notice, in which case it will return your Boxes at no charge and refund your Deposit and any prepaid fees for the period after the return.

14. Ending Storage and Returning Boxes

To end storage of a Box, request the Box, empty it, and return it to the storefront or, where offered, schedule a courier pickup of the empty Box. A Box is received when Fort Lox scans its QR code as returned. The monthly fee for that Box continues until it is received back empty and in good condition, and the last month is not prorated. This Agreement ends when every Box has been received back, all charges have been paid and your Deposit has been settled.

15. Your Representations

You represent that you are at least 18 years old, that you own the Stored Property or have the owner's authority to store it, that no other person has a lien on or claim to it, that it is lawful and contains no Prohibited Items, and that the information in your account, including your mailing address, is accurate and will be kept current.

16. Indemnification

You will defend, indemnify and hold harmless Fort Lox and its members, managers, employees, agents and couriers from all claims, losses, liabilities, damages, fines, cleanup costs and expenses, including reasonable attorneys' fees, arising out of your breach of this Agreement, Prohibited Items, improper packing, the condition of your Stored Property, any third party's claim to your Stored Property, or injury or property damage at your address caused by conditions you control.

17. Termination by Fort Lox for Breach

Fort Lox may terminate this Agreement immediately on written notice if you store Prohibited Items, breach Section 15 or use the Service unlawfully, and on ten days' written notice for any other breach that you do not cure within that period. On termination for breach Fort Lox may return your Boxes under Section 11 or, if a Box cannot be returned, proceed under Section 12.

18. Notices, Electronic Records and Communications

Fort Lox may give you any notice under this Agreement by email to the address on your account, by text message to the mobile number on your account, or by notice in the app, and the notice is effective when sent. Notices under Section 12 will also be sent as that Section requires. You may give notice to Fort Lox by email to fortloxstorage@gmail.com or by mail to FortLox LLC, [15553 SW 16th Street, Davie, FL 33326 — confirm notice address]. You consent to receive transactional emails, text messages and calls about your account, orders, retrievals, payments and legal notices, which are not marketing. You agree that this Agreement and all related records may be delivered and signed electronically under the federal E-SIGN Act and Section 668.50, Florida Statutes, and that your electronic acceptance has the same effect as a handwritten signature.

19. Dispute Resolution

Any dispute arising out of or relating to this Agreement or the Service will be resolved by binding individual arbitration under the American Arbitration Association Consumer Arbitration Rules, administered in Broward County, Florida. Before filing a demand for arbitration, each party will attempt to resolve the dispute informally for at least 30 days. Either party may bring a claim in small claims court in Broward County instead of arbitrating. YOU AND FORT LOX EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. You may opt out of this arbitration clause by sending written notice to Fort Lox within 30 days after you first accept this Agreement. Nothing in this Section prevents Fort Lox from acting under Sections 11, 12 or 13.

20. General Terms

This Agreement, its Schedules, the Terms of Service and the Privacy Policy are the entire agreement between you and Fort Lox about the Service. Fort Lox may update Schedule B and the Terms of Service as they provide, and may amend this Agreement on at least 30 days' written notice, with your continued use of the Service after the effective date constituting acceptance; if you do not accept the amendment you may terminate this Agreement before the effective date by returning your Boxes under Section 14, in which case the prior terms apply through the date of return. This Agreement is governed by Florida law. If any provision is unenforceable, the rest remains in effect. Fort Lox's failure to enforce a provision is not a waiver. You may not assign this Agreement. Fort Lox may assign it to an affiliate or a successor to its business and may perform the Service through contractors and couriers. In any action to enforce this Agreement the prevailing party may recover its reasonable attorneys' fees and costs. Neither party is liable for delay caused by events beyond its reasonable control, except that your payment obligations are not excused. Sections 4, 5, 7, 9, 10, 11, 12, 13, 14, 16, 19 and 20 survive termination.

Schedule A — Storefront, Retrieval and Courier Policy

This Policy is part of the Fort Lox Storage Service Agreement. Capitalized terms have the meanings given in the Agreement.

A-1. Storefront Pickup and Return

Empty Boxes ordered in the app are ready for pickup at the storefront during business hours on the date shown in your order confirmation. You or an adult you have authorized in the app must present government-issued identification and sign electronically for each Box collected. Bring packed and locked Boxes to the storefront during business hours. Fort Lox will scan each Box's QR code, weigh it, photograph it, note its condition and record it as received. Fort Lox may decline a Box that is overweight, unlocked, damaged, leaking, emitting odors or appears to contain Prohibited Items.

A-2. Retrieval to the Holding Area

Request a Box in the app. When it is ready, the app will notify you, and the Box will be held in the storefront holding area for collection during business hours. Collect it by presenting identification and scanning its QR code. You may open the Box in the customer area and return it to Fort Lox the same visit, or take it home. A Box not collected within [three] business days after it is ready may be returned to storage, and you may request it again.

A-3. Optional Courier Delivery and Pickup

Where Fort Lox offers courier service, you may schedule delivery of empty Boxes, pickup of packed Boxes, and delivery of retrieved Boxes to an address within the delivery area shown in the app, for the flat fee in Schedule B, in the time slots Fort Lox makes available and subject to courier availability. Fort Lox may limit the number of courier appointments per day. Times are estimates. You may reschedule or cancel a slot without charge up to [24] hours before it begins. A later cancellation, or a reschedule after the courier is en route, is a missed appointment and is charged the missed-appointment fee.

A-4. Presence, Signature and Signature Waiver

For every courier delivery and pickup, you or an authorized adult must be present, present identification and sign electronically. If no authorized adult is present, the appointment is missed and the missed-appointment fee applies. When scheduling a delivery you may instead waive signature and designate a specific location at your address where Boxes may be left. If you do so, the courier will leave the Boxes at that location, photograph them where left and mark the delivery complete in the app. From that moment the Boxes and their contents are in your possession and at your risk. Fort Lox is not responsible for loss, theft or damage after a Box is left at your designated location, and you will pay the replacement cost of any Box that is lost or stolen after being left. Fort Lox will not leave Boxes without a signature unless you have waived signature for that specific appointment.

A-5. Courier Pickup Checklist

Before a courier pickup you must confirm in the app that each Box contains no Prohibited Items, is within the weight limit and is secured with a Fort Lox lock. The courier will photograph each Box, scan its QR code, note its condition and weight, and record any concern in the app. The courier may decline a Box for the reasons in Section A-1, and a declined pickup is charged the missed-appointment fee. Fort Lox's record of a pickup or storefront receipt is evidence of the condition of the Box at that time.

A-6. Access at Your Address

You must ensure that your address is accessible during a courier slot, including gate codes, building access and parking. Boxes are delivered to and collected from the front door or ground-floor entry unless the courier agrees otherwise. Deliveries above the ground floor without a working elevator may be declined or charged an additional handling fee.

A-7. Couriers

Fort Lox performs courier service through its own personnel or independent courier companies acting on its instructions. Couriers are not authorized to change this Policy or the Agreement, to accept cash or to open a Box.

This Schedule applies only if you accept the Agreement using a pilot program code. Fort Lox is testing its operations before opening to the public, and you have agreed to help.

You acknowledge that the Service is in a pilot phase and that Fort Lox's storefront, app, courier arrangements and procedures are still being tested and may change without notice. You agree not to place in any Box anything with a value exceeding the Declared Value of that Box, and you agree that the Declared Value of each Box under Section 9 of the Agreement is [$100] unless Fort Lox agrees otherwise in writing. You agree that your pilot program discount code is personal to you and may be withdrawn at any time, and that when the pilot ends Fort Lox may convert your account to a standard package on 30 days' notice or return your Boxes at no charge. You agree to give Fort Lox honest feedback about your experience and consent to Fort Lox's use of that feedback, without your name, to improve the Service. All other terms of the Agreement apply.
