Terms of Service

1. Agreement to Terms

By accessing or using our Services, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you are using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

2. Eligibility and Accounts

2.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract under Florida law to create an account or enter into a storage agreement with Fort Lox. By using the Services, you represent that you meet these requirements.

2.2 Account Registration

To access most features (including ordering boxes, subscribing to storage plans, and scheduling pickups/retrievals), you must register for an account and provide accurate, current, and complete information, including a valid payment method. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at fortloxstorage@gmail.com if you suspect unauthorized access.

2.3 Admin and Staff Accounts

Certain accounts and portals are provisioned strictly for authorized Fort Lox personnel and facility administrators. Any unauthorized access to or tampering with admin or staff functionality is strictly prohibited.

3. Storage Services

3.1 Nature of the Storage Relationship

Fort Lox provides convenient on-demand valet storage solutions. We store physical items and boxes ("Stored Property") provided by you in accordance with your selected subscription tier. You retain title and ownership of all Stored Property. Fort Lox acts as a bailee for mutual benefit: Fort Lox agrees to exercise reasonable care in storing your Stored Property, and you agree to the terms governing access, prohibited items, payment, and liability.

3.2 Prohibited Items

You agree NOT to store any of the following items ("Prohibited Items"):

• Explosives, firearms, ammunition, fireworks, or weapons of any kind
• Hazardous, toxic, radioactive, combustible, corrosive, or flammable materials
• Illegal drugs, controlled substances, or illegal contraband
• Perishable items, food, opened liquids, or items prone to spoilage or attracting pests
• Living creatures, plants, or organic/biological materials
• Cash, currency, negotiable instruments, deeds, bullion, or irreplaceable high-value jewelry
• Stolen goods or property you do not have the lawful right to possess and store
• Items emitting strong odors, leaking liquids, or posing a safety hazard to personnel or facility property

Fort Lox reserves the right to inspect, refuse, or immediately remove any Stored Property that we reasonably suspect violates this section, without prior notice.

3.3 Access to Stored Property

Stored Property is kept in secure, climate-controlled storage facilities. Physical walk-in access by customers to the storage warehouse is not permitted for security and safety reasons. Delivery and retrieval of your Stored Property is managed through our scheduled pickup and delivery service via our website or mobile app.

3.4 Limitation of Liability for Stored Property

Standard Valuation: Fort Lox's total maximum liability for loss of or damage to Stored Property arising from any cause (including negligence) is limited to the value declared by Customer at check-in (the "Declared Value"), or if no Declared Value is recorded, up to $0.60 per pound per item up to a maximum total of $250 per box/item (or $500 per customer account).

FORT LOX IS NOT AN INSURER. You are strongly encouraged to maintain your own property insurance or renters/homeowners insurance covering your Stored Property while in storage or transit.

Exclusions: Fort Lox is not liable for loss or damage caused by improper packaging by the customer, normal wear and tear, inherent vice, acts of God, extreme weather, flooding, fire, civil unrest, or loss of Prohibited Items.

3.5 Non-Payment, Default, and Lien Rights

Pursuant to applicable Florida self-storage facility and warehouse statutes (including Fla. Stat. § 83.801 et seq.) and other applicable laws, Fort Lox has a possessory lien upon all Stored Property for unpaid subscription fees, storage charges, late fees, and handling expenses. If your account remains past due for 30 consecutive days, Fort Lox reserves the right to enforce its lien by selling, auctioning, disposing of, or otherwise liquidating Stored Property to satisfy outstanding balances, in accordance with applicable statutory notice procedures.

4. Subscriptions, Fees, and Payment

4.1 Recurring Billing

Storage plans are billed on a recurring subscription basis (monthly, unless otherwise stated) to your payment method on file. By subscribing, you authorize Fort Lox (via Stripe) to automatically charge your payment method each billing cycle until cancellation.

4.2 Auto-Renewal and Cancellation

Your subscription automatically renews at the end of each billing cycle unless you cancel through your account settings or by contacting fortloxstorage@gmail.com. Cancellation takes effect at the end of the current billing cycle. All Stored Property must be scheduled for retrieval and return prior to account termination.

4.3 Price Changes

Fort Lox reserves the right to adjust subscription rates or service fees upon at least 30 days' advance notice via email or website/app notification. Continued use after the effective date constitutes acceptance of new pricing.

4.4 Refunds

All fees paid are non-refundable, except as expressly provided in these Terms or required by applicable law. Partial billing periods are not prorated.

4.5 Late Fees

If a payment fails or is overdue, Fort Lox may charge a reasonable late fee of $15 or 5% of the overdue balance (whichever is greater), to the extent permitted by law, and may suspend service or exercise lien rights.

5. User Content

You may upload photos, box labels, descriptions, item lists, and profile information ("User Content"). You retain ownership of your User Content. You grant Fort Lox a worldwide, royalty-free license to host, store, and display your User Content solely to operate and improve the Services (such as displaying your stored item catalogue to you).

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of federal, state, or local laws;
• Attempt to gain unauthorized access to any accounts, computer systems, or networks connected to Fort Lox;
• Reverse engineer, decompile, or disassemble any part of the website or application;
• Interfere with or disrupt the security, integrity, or performance of the Services;
• Store any Prohibited Items in violation of Section 3.2;
• Upload malicious code, worms, viruses, or automated scraping tools.

7. Intellectual Property

The website, mobile application, brand logos ("Fort Lox" and "Fort Lox Storage"), software, content, graphics, and visual design are owned by FortLox LLC or its licensors and are protected by United States and international intellectual property laws.

8. Third-Party Services

The Services may integrate with third-party providers (such as Stripe for payments, authentication providers, and mapping services). Fort Lox is not responsible for third-party websites, terms, or privacy policies.

9. Disclaimers

EXCEPT AS EXPRESSLY STATED HEREIN, THE SERVICES AND APP ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FORT LOX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, COMPLETELY ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORTLOX LLC, ITS DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL). IN NO EVENT SHALL FORT LOX'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO FORT LOX IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) $250.

11. Indemnification

You agree to defend, indemnify, and hold harmless FortLox LLC and its officers, directors, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your access to or use of the Services; (b) your violation of these Terms; or (c) your storage of Prohibited Items.

12. Term, Suspension, and Termination

These Terms remain in effect while you maintain an account or use our Services. Fort Lox may suspend or terminate your account immediately if you breach these Terms or fail to pay applicable storage fees.

13. Dispute Resolution and Arbitration

13.1 Agreement to Arbitrate

You and Fort Lox agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may assert individual claims in small claims court.

13.2 Class Action Waiver

YOU AND FORT LOX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13.3 Right to Opt Out

You may opt out of this arbitration provision by sending written notice within thirty (30) days of first accepting these Terms to fortloxstorage@gmail.com.

14. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. For any action not subject to arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.

15. Changes to These Terms

We may update these Terms from time to time. Material updates will be notified via our website or email at least 14 days before taking effect. Continued use of the Services indicates acceptance of the updated Terms.

16. Miscellaneous

These Terms, together with our Privacy Policy and any storage order confirmation, constitute the entire agreement between you and Fort Lox. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
